The Renters Reform Bill: What Southampton Landlords Need to Know

A New Era for Private Renting

The private rental sector is on the brink of its most significant transformation in over three decades. The Renters’ Rights Bill, which passed through the House of Lords in July 2025, is expected to receive Royal Assent by September and become law by early 2026. When Will Changes Take Effect?

Current Status: The Bill completed its passage through the House of Lords on 21 July 2025. Parliament returns from summer recess on 8 September 2025, when the “ping pong” process between Commons and Lords will begin to resolve any final amendments.

Expected Royal Assent: September 2025

Implementation: Early to mid-2026, with a “big bang” approach where all tenancies (new and existing) convert to the new system simultaneously

Preparation Period: The government has committed to providing sufficient notice and support to help all stakeholders prepare for the transition.

Key Changes: What’s Actually Happening?

1. The End of Fixed-Term Tenancies

The Change: All Assured Shorthold Tenancies (ASTs) will become periodic (rolling) tenancies overnight when the Act comes into force. This means:

  • No more 6 or 12-month fixed terms
  • All existing fixed-term tenancies will automatically convert to periodic
  • Tenancies will run month-to-month until ended by notice

Impact for Southampton Landlords: While this removes the certainty of fixed terms, our data shows the average tenancy length in Southampton is already around 25 months. Good landlords with well-maintained properties may actually see longer, more stable tenancies as tenants no longer face the disruption of repeated renewals.

2. Section 21 ‘No Fault’ Evictions Abolished

The Change: Landlords will only be able to regain possession using enhanced Section 8 grounds, which must cite specific reasons such as:

  • Rent arrears
  • Anti-social behaviour
  • Landlord or family member moving in
  • Property sale (with restrictions)
  • Property redevelopment

3. Rent Increases Limited and Regulated

The Change:

  • Rent increases limited to once per year
  • Must use Section 13 notices only
  • Two months’ notice required (up from one)
  • Tenants can challenge “excessive” increases at tribunal

4. Ban on Rental Bidding Wars

The Change: Landlords and agents must publish an asking rent and cannot encourage or accept bids above this price. Fines up to £7,000 for initial breaches, rising to £40,000 for repeat offences.

5. Restrictions on Rent in Advance

The Change:

  • Maximum one month’s rent in advance (once tenancy signed)
  • No rent payments before tenancy agreement is executed
  • Exception: Existing tenancies signed before the Act can continue with current arrangements

Practical Impact: This may require adjustments to cash flow management but protects tenants from excessive upfront costs that can prevent them from moving.

All landlords must register themselves and their properties on a new government database. This will:

  • Improve transparency for tenants
  • Help local authorities track compliance
  • Support enforcement against rogue operators
  • Provide guidance and information to landlords

A new mandatory redress scheme will handle disputes between landlords and tenants, offering:

Decent Homes Standard: Extended from social housing to private rentals, setting minimum requirements for:
